Privacy Notice Under Turkish Law No. 6698 on the Protection of Personal Data (KVKK)

This Privacy Notice has been prepared by SOFTCARE SAĞLIK HİZMETLERİ VE LİMİTED ŞİRKETİ ("SoftCare Clinic" or the "Company"), acting as data controller, in accordance with Article 10 of Law No. 6698 on the Protection of Personal Data ("KVKK"), the Turkish personal data protection law, and the related Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

2. Personal Data Processed

Depending on the purpose of the transaction, the following categories of personal data may be processed through our website and appointment/contact forms:

  • Identity Data: First and last name
  • Contact Data: Phone number, email address
  • Health Data (Special Category Personal Data): The service/department requested in your appointment and any additional notes shared in the form
  • Transaction Security Data: IP address, cookie data, form submission timestamp, security verification (Cloudflare Turnstile) record

3. Purposes of Processing

Your personal data is processed for the purposes of:

  • Receiving, evaluating, and following up on your appointment request,
  • Responding to your inquiries, questions, and suggestions,
  • Planning and carrying out the services provided,
  • Improving service quality and internal operations,
  • Fulfilling obligations arising from applicable laws and carrying out legal processes,
  • Ensuring website security and preventing misuse (bots/spam)

within the personal data processing conditions set out in Articles 5 and 6 of the KVKK.

4. Method of Collection and Legal Basis

Your personal data is collected electronically when you fill out the appointment and contact forms on our website. Your identity and contact data are processed on the legal grounds of KVKK Art. 5/2 — "being directly related to the establishment or performance of a contract" and "being necessary for the legitimate interest of the data controller, provided this does not harm your fundamental rights and freedoms."

Your special category personal data constituting health information is processed only with your explicit consent under KVKK Art. 6, which is separately and explicitly obtained when you confirm the appointment form.

5. Transfer of Personal Data

Your personal data is transferred to our appointment and patient management system for the purpose of carrying out the appointment process. Your data is not shared with third parties or transferred abroad outside of the purposes listed above, except where required by law (e.g., requests from authorized public institutions).

6. Retention Period

Your personal data is retained for as long as required by the purpose of processing and in accordance with the statutory limitation periods set out in applicable legislation (Ministry of Health regulations, Turkish Commercial Code, Tax Procedure Law, etc.), after which it is deleted, destroyed, or anonymized.

7. Rights of the Data Subject

Under Article 11 of the KVKK, as a personal data subject you have the right to:

  • Learn whether your personal data is being processed,
  • Request information if it has been processed,
  • Learn the purpose of processing and whether it is used in accordance with that purpose,
  • Know the third parties to whom it is transferred domestically or abroad,
  • Request correction if incomplete or inaccurately processed,
  • Request its deletion or destruction within the framework of the conditions set out in KVKK Art. 7,
  • Request that the above operations be notified to third parties to whom the data has been transferred,
  • Object to a result that arises to your detriment through analysis of the processed data exclusively via automated systems,
  • Request compensation for damages in case you suffer a loss due to unlawful processing

8. Application Method

You may submit your requests regarding the rights listed above, together with documents verifying your identity, in writing to our address above, via a notary, or through other methods determined by the Turkish Personal Data Protection Board. Your request will be concluded free of charge, as soon as possible and within 30 (thirty) days at the latest, depending on its nature.
